These Terms and Conditions are a vital part of the agreement outlined on the front side of this document between the Customer and AAA Garage Door Repair 24/7 LLC.
a) The Customer retains the right to cancel this agreement and work order within three (3) business days from the date of signing, provided that the cancellation occurs before any installation or on-site work begins. Cancellation requests must be submitted in writing and signed by the Customer. Cancellations within this window will not incur any costs.
b) The Customer understands that placing a special order (including but not limited to custom doors/openers, orders for three or more items, out-of-stock or unique items) results in a waiver of the right to cancel, and the Customer will bear full financial responsibility for any work completed by AAA Garage Door Repair 24/7.
c) If cancellation occurs after the three-day grace period but before the installation date, a restocking fee of 25% of the total job cost will apply. The remaining balance of the deposit will be refunded.
a) Installation start dates listed on the front of the agreement are estimates only and dependent on AAA Garage Door Repair 24/7’s scheduling availability. While AAA Garage Door Repair 24/7 will make reasonable efforts to meet those dates, it is not liable for delays due to external circumstances, supply shortages, government regulations, or events beyond its control. In such situations, AAA Garage Door Repair 24/7 reserves the right to allocate supplies at its sole discretion.
b) If the Customer causes a delay, requests changes to installation dates or locations, or requests additional work not originally agreed upon, all quoted prices will become void, and new pricing will be issued.
The Customer agrees to review and sign off on all designs, product selections, and installation instructions prior to commencement of any work. AAA Garage Door Repair 24/7 is not responsible for executing work per those specifications.
Once AAA Garage Door Repair 24/7 notifies the Customer that the work is complete, the Customer must inspect the work within three (3) business days. Any claims must be submitted in writing within that timeframe. If no written notice is received, the work is deemed accepted, and full payment is required.
a) A 33% deposit is due at the time of signing unless otherwise agreed in writing. Remaining balances are due upon completion of installation.
b) No discounts or refunds will be offered after work is complete. All sales are final.
c) Late balances are subject to the maximum legal interest rate from the date of delinquency. If collection services are required, the Customer is responsible for all associated legal and collection costs.
d) AAA Garage Door Repair 24/7 retains a security interest in all installed products until full payment is made. This may involve additional legal documentation and filings at AAA Garage Door Repair 24/7’s discretion.
e) If the Customer defaults on payment or becomes insolvent, AAA Garage Door Repair 24/7 may halt performance or remove installed equipment.
f) AAA Garage Door Repair 24/7 reserves the right to adjust credit terms at any time based on the Customer’s payment history or financial condition. If the Customer fails to agree to such new terms within thirty (30) days, it will be treated as a cancellation of the unexecuted portion of the order.
The Customer is responsible for all applicable sales taxes. If claiming exemption, the Customer must provide appropriate documentation to AAA Garage Door Repair 24/7.
a) The purchase price does not include installation unless otherwise stated. The Customer must ensure the site is fully prepared, including access to necessary utilities (power, water, permits, etc.).
b) Failure to prepare the site may result in a service fee.
c) The Customer must ensure a safe environment for AAA Garage Door Repair 24/7 technicians and is liable for any injuries or damage unless caused by the gross negligence of AAA Garage Door Repair 24/7.
i) AAA Garage Door Repair 24/7 warrants that all products are free from material and workmanship defects at the time of delivery.
ii) Installation workmanship is covered under a 12-month warranty from the installation date. Manufacturer warranties apply to equipment like doors, openers, and electronics.
iii) Warranty applies only to the original purchaser and is non-transferable.
iv) Warranty remedies are limited to repair, replacement, or refund at the discretion of AAA Garage Door Repair 24/7.
v) The warranty does not cover damage caused by misuse, improper maintenance, site issues, or unauthorized repairs.
vi) Used, refurbished, or “As Is” items carry no warranty unless explicitly stated.
DISCLAIMER: AAA Garage Door Repair 24/7 DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. AAA Garage Door Repair 24/7 SHALL NOT BE LIABLE FOR INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES UNDER ANY LEGAL THEORY.
Acceptance of a quote or order by the Customer constitutes agreement to these terms. Any contradictory terms presented by the Customer are void unless agreed upon in writing by AAA Garage Door Repair 24/7.
a) Excusable Delays: AAA Garage Door Repair 24/7 is not liable for delays caused by acts of God, third-party interference, labor shortages, or any cause beyond its control.
b) Governing Law: These terms are governed by the laws of the State of Florida, and all legal disputes must be resolved in courts located in Florida.
c) Confidentiality: AAA Garage Door Repair 24/7 may require a separate confidentiality agreement before sharing proprietary information. AAA Garage Door Repair 24/7 is not obligated to accept any confidential information from the Customer without prior written agreement.
d) Assignment: Customer may not assign this agreement without written consent from AAA Garage Door Repair 24/7. Unauthorized assignments are void.
e) Severability: If any clause is found unenforceable, the remaining provisions shall remain in full force.
